What makes you conclude he never actually did? Where there is smoke, there is fire.
The man went out of his way to ensure that he had legal memoranda written justifying actions that most of us would recognize as despicable. He ensured those memoranda remained totally secret. With five days left in his administration, all were curiously then revoked. This follows a similar pattern with respect to the infamous torture memo, followed by clear reports of torture, including waterboarding, which the administration also denied initially.
