The fraud is the intentional misrepresentation that you are clean and qualified to race when, in fact, you are dirty, thus inducing the transfer of federal funds. It is not just a common law claim, as I understand it, but also a statutory claim based on some federal statute. But, they will need to prove a lot and it will take more than a discredited former Mennonite and Frankie Andreu's wife to convict him.
