Usually, when I ask the question of people who identify with the Republican party, I get the usual crap back about frivolous lawsuits, punitive damages, and tort reform. I can't say I understand the trial system, but you don't think we've become too much of a litigous society? This is the problem I see:

*There is a surplus of lawyers in this country.
*32 Now the object of these lawyers was to get gain; and they got gain according to their employ (Alma 10:32).
*Since the more cases they do, the more money they make, their incentives are aligned in such a way that they would look for ways to sue people.
*When you sue people, you're not creating wealth, you're just transferring wealth. From an economic standpoint, that's a wasteful activity.
*Like any other profession, you're responding to a demand, but lawyers can create their own demand.

I true Repubican favors market forces such as curbings through consumer forces in the courtroom. It is one of the truest form of a consumer reacting to bad products, and society agreeing or disagreeing. For those not intimate with the court system, belief that juries hand out unjustified rewards is naive and nonsense.

You are only Republican in the sense that Republicans like authoritarianism. In reality I submit the truest Republican likes as little authoritarianism as possible, again, a la market forces.


In my mind, upper left represents whack Dems such as Hillary. Lower left represents naive Do-Gooders, lower right represents correct thinking, rational, empiricists who desire the best for their fellow man but desire it to be delivered in the most efficient manner i.e., Republicans, and uppr right quandrant is reserved for power hungry control freaks. Il Duce comes to mind.

I am not saying, that no lawyers endeavor to create demand, and the ones most likely so engaged are the class action lawyers, but anecdotally as one familiar with the legal system in one way or another for forty years

Lawyers really make money by being efficient. Some mills bill the crap out of cases but most lawyers are working a case to win, not to increase the stuff. There will always be enough work. I could work 24/7 if I chose without trying to increase the work. I turn work away because of lack of opportunity. Now, if you say, profitable work that will let me live like the rich and famous, that's another matter. That is limited and I'd be happy to hit some multi-billion dollar awards, but it won't happen, so I plug away.

OK, maybe you're right. But why do I see Dexterlaw.com on the scoreboard of the Marriott Center, and on buses all over Provo. Why do lawyers have to advertise? If it just because people don't think about suing when they get injured?

The difference I see between trial attorneys seeking to increase business and this scripture is that in Alma, it was the judges that were paid for their services, by the government, rather than lawyers who are paid by their clients. In Alma, when the controversies were created, the judges automatically got their benjamins. Today, whether through billed hours or contingency, it is the client that is paying, and ultimately choosing to hire the attorney.

Yes, but the lawyers are performing a service for which they are receiving compensation. Merely "transferring wealth" is not a bad thing, on the contrary it is good because theoretically the wealth is being transferred to the rightful owner, thus ensuring that economic incentives remain in place.

Has a culture and unreasonable expectations been created? Perhaps in all sectors.

If I can't get a job, I expect the government to mandate a job for me.

If I can't get health care I expect taxpayers to give it for me.

It's all part of the gimme culture socialism creates for us.
