Tex, you are trying to be a vituoso, but I won't play your quiz show.
I read things, btw. I'm up on my current events. Orange County is a microcosm of America.

Hear ye indeed, but understand not; and see ye indeed, but perceive not.

I haven't the slightest idea what Tex is getting up on his high horse about, but I'm quite sure that he loves every word he's typing.
Will he yet again convince himself of how right he is? I know we're all on the edge of our seats to find out.

In her defense, I'm a lawyer, and I have the hardest time remembering case names, particularly cases that I don't deal with on a daily basis.
But then again, I'm not a V.P. candidate. On the other hand, I don't look like this in a swimsuit:

I struggle with case names too. But I can talk about concepts and facts till the cows come home. For example, I don't offhand remember the key procedural or substantive due process or equal protection cases, though I've dealt with them a fair amount in my practice, but I could knowledgeably discuss them at length. Same with the exclusionarly rule and all its permutations. But I do remember Bivens v. Six Unknown Federal Narcotic Agents (fruit of the poisonous tree) because it's such a cool name.

The context of the interview is here prefixed by similar questions to Joe Biden.
Contrary to media reports, Couric asked her for another Supreme Court case she disagreed with, not to just name any case. Many of the cases cited in this thread are not among those people would readily dispute (Brown v. Board, Marbury, Plessy, etc), so the Politico report was wrong and generated a lot of unfair criticism. That said, I personally would've loved to hear a blistering rebuke of Kelo, but alas, she just retreats to generic federalist ground. She seems unprepared for the question. As for Biden, his response was absolutely pathetic. He didn't cite the case, so I can't look it up, but based on his description it sounds like the Supreme Court was right to slap him down.

Also, one can agree to a right to privacy (such as in the 4th amendment) and still disagree with the premise of Roe, nor is that inconsistent with federalism. And let's not forget how wrong you (and the Politico) were about the initial report. EDIT: The Corner notes further the responses of both recent SCOTUS picks to the same question: Quote:
