2 new guys started at work today....
They were standing near the front.....they seemed nervous and a bit lost...so I couldn't help myself....
"Hey guys!" They nod...one of them holding a Super Big Gulp..... "Big Gulps huh?" They nod and smile in approval.... "Welp! See ya later!" Walk down the office to my desk to the snickers of several on the floor.

We hired a new person.
The problem she lied about not being smoker. Do all smokers just plain lie? Even if I weren't LDS, I would detest the habit of smoking. It stinks.

The real problem is that then they need smoking breaks and then if you let them have a smoking break the non-smokers eventually wonder why THEY don't a break also and why smokers get favored status and then you have to formulate a policy to deal with it.......Ugh.

We have the problem of having two ladies who are worth their weight in gold in positions that have been tough to fill. If they can't smoke their productivity drops way off. We have just decided to have no policy on it and let them discretely have their breaks. If others are bothered by it, too bad.

Could you get sued for unfair employment practice?
You know, for asking about smoking?...I suppose only if you refuse to hire on that basis.
I work on a smoke-free campus, so the smokers walk minimum 1/2 mile for their smoke breaks, and I'm thinking, they get PAID for this. And then the rest of us have to smell them when they get back. |

It depends upon the state, but usually no. I don't know about Oklahoma.
People should ask. As I agree, smokers get a free ride for a disgusting, unhealthy habit. Society gets to pay their medical costs as well. My dishonest employee grabbed something for me and the item she grabbed smelled like smoke. Obviously I have some clients who smoke and who otherwise are decent people. But dang them, they might die too early not having paid me enough fees. Steve Martin's old monologue about smoking is still one of my favorites. Now I don't remember it verbatim, but it runs something like this, " If people ask me if I mind if they smoke, I say, no, go ahead. Do you mind if I fart? I tried to quit once, but gained a lot of weight ....
